Wikipedia:Copyright problems

From Wikipedia, the free encyclopedia

This is an old revision of this page, as edited by LittleDan (talk | contribs) at 20:43, 23 September 2003. The present address (URL) is a permanent link to this revision, which may differ significantly from the current revision.

Add links to pages that you suspect of being copyright infringements here. Page titles should stay listed for a minimum of 7 days before a decision is made.

As well as nominating potential copyvios for deletion, you could:

  • replace them with new content of your own, or
(however, note that by replacing the content you are creating a page history that starts with a possible copyright violation, i.e. the original page history will have the infringing copyright material residing on Wikipedia. There is no clear consensus about what to do about this problem or what it means. The more prudent course of action may be to wait until the page is deleted and then create a new page without the infringing material on the page history. (this is currently under discussion, until a policy is agreed upon it is up to you to decide what to do, see the talk page and Wikipedia:Copyright violations on history pages) [added September 5, 2003]).

(newly added on 8/27/03 - subject to revision, please post comments on the talk page)

If you believe Wikipedia is infringing your content, you may choose to raise the issue using this page and the standard copyright infringement notice as described below. Alternatively, you may choose to contact Wikipedia's designated agent under the terms of the Online Copyright Infringement Liability Limitation Act.

Note that Wikipedians do not have the ability to remove copyright infringements from an article's page history. Therefore, if you believe that material in an article's page history infringes your copyright, you should contact Wikipedia's designated agent, rather than using this page.

Add the following text to pages that you list here, replacing whatever was previously in the article.

Removed possible copyright infringement. Text that was previously posted here is the same as text from this webpage:
:
This page is now listed on Wikipedia:Votes for deletion/copyvio. To the poster: If there was permission to use this material under terms of our license or if you are the copyright holder of the externally linked text, then please indicate so on this page's talk page (to access the talk page, click on Discuss this page in the sidebar). If there was no permission to use this text then please either replace this message with at least a good stub and an external link or leave this page to be deleted. (NOTE: unless a stub replaces this text, deletion will occur about one week from the time this page title was placed on the Votes for deletion page).
It also should be noted that the posting of copyrighted material that does not have the express permission from the copyright holder is possibly in violation of applicable law and of our policy. Those with a history of violations may be temporarily suspended from editing pages. If this is in fact an infringement of copyright, we still welcome any original contributions by you.
Thanks, ~~~~

  • Image:Strait of gibraltar.jpg -- description say probably free. -- Looxix 00:27, 18 Sep 2003 (UTC)
    • I'd say keep. Based on the nature of the photograph, it's a pretty good guess that it's a NASA photograph. There are commercial satellites, but they mostly take high-resolution top-down photographs, not pictures like this. If it is in fact a copyright violation (which I don't think is likely), someone can always complain and we'll take it down at that point. --Delirium 04:02, Sep 18, 2003 (UTC)
    • Problem is that a lot of all these nice image are produced by the JPL are their images are not free (cfr. http://www.jpl.nasa.gov/images/policy/index.cfm). Of course, I don't know about this pic. -- Looxix
  • Susan Haack. Copy of [5]. RickK 03:39, 18 Sep 2003 (UTC)
    • I've replaced the boilerplate with a brief stab at an article on Haack, who seems worthy enough of a couple paragraphs. If what I've done is agreeable to the rest of you, perhaps we can avoid deleting? Jwrosenzweig 03:48, 18 Sep 2003 (UTC)
      • I have no problem with that, except for it leaving the copyvio in the article history. Is there a problem with that? RickK 03:53, 18 Sep 2003 (UTC)
      • Ah, excellent point...I think we are encouraged to avoid that scenario. Assuming no one has any objection to deleting the copyvio, couldn't we copy the text of the present article, delete the page, and re-open the page by pasting back in the copied text? Or is this too much of a production for a fairly simple couple paragraphs that could easily be rewritten someday? Jwrosenzweig 04:09, 18 Sep 2003 (UTC)
      • Nope, it's not a big production at all. Go ahead and do it with your new sysop powers. (I would do it myself, but then my name would appear as the first editor.) -- Cyan 04:49, 18 Sep 2003 (UTC)
        • I have no problem with that. Go for it, James. RickK 04:51, 18 Sep 2003 (UTC)
          • Done. Thanks, Cyan and Rick, for the encouragement! Jwrosenzweig 16:40, 19 Sep 2003 (UTC)
  • Rocketdyne Santa Susana Field Laboratory Contamination. Not only does the article claim to be copyrighted, but it's hardly NPOV. RickK 03:30, 18 Sep 2003 (UTC)
    • (Articles that aren't NPOV should go on Wikipedia:Pages needing attention get a NPOV dispute header). -- Cyan 04:58, 18 Sep 2003 (UTC)
      • Look, I was on the verge of just deleting the thing, but thought better of it and listed it on VfD. Have you read the article? You might find why I put it here. There is no point to to the Wikipedia:Pages needing attention page, as nothing gets resolved there. RickK 05:07, 18 Sep 2003 (UTC)

  • Image:Padres-logo.gif and Image:Dodgerslogo.gif are copyrighted property of their respective organizations. Unless someone has obtained written permission from both the teams and Major League Baseball, these images would constitute copyright violations. This would be true of all North American sports logos on either the college or professional level. Licensing and merchandising are big money for sports. There maybe more in the MLB pages, but these are the two I noticed. vudu 00:39, 23 Sep 2003 (UTC)
    • There are more. It would appear that the culprit would be User:LittleDan, who would also appear to be about fourteen years old his user page is to be believed). Probably just being zealous. A quick look at his contribution list unearthed logos for the Cleveland Indians, Miami Dolphins, and Anaheim Angels as well. As an aside, these really aren't copyright violations, but trademark infringement. vudu 00:56, 23 Sep 2003 (UTC)
      • I'm sorry. When I uploaded those, I had a bad sense of copyright law. Since nobody sells that logo, I thought it could be used, but now I understand how it works. LDan 20:43, 23 Sep 2003 (UTC)
