Jeremy Hinzman is a US army private from the US 82nd Airborne Division in North Carolina. In early 2004 he fled to Canada seeking refugee status.

He fought in Afghanistan, but when ordered to Iraq he deserted to Canada, along with his wife Nga Nguyen, after his application to be designated a conscientious objector was denied.

He is battling the US military in the Canadian courts, along with 3 other soldiers, but the government is challenging their case as he "does not fit the criterion for status refugees."

The hearing begins on Dec 6 2004, where he will argue that the invasion of Iraq was an international human-rights violation in which he couldn't morally take part in.

Hinzman and his lawyer are optimistic about his chances of being able to remain in Canada.
