Mistitled?
[edit]Surely this article ought to be retitled 'Bar of Ireland'? The second sentence mentions the General Council of the Bar of Ireland, presumably as a governing body for the profession; however, no clear statement is made of the purpose of the GCBI, and very little mention seems to be made of the GCBI itself in the main body of the article. - Well, I guess so. I am very much not a lawyer.
- In common-law jurisdictions the distinction is between a bar council regulating barristers and a law society regulating solicitors. In Category:Bar of England and Wales there are separate articles General Council of the Bar and Barristers in England and Wales, with Bar of England and Wales redirecting to the latter. Category:Bar of Ireland has only this one article for both. A barrister is "called to the bar" and thereafter a "member of the bar" and there are "rules of the bar" but I don't think "the bar" has any legal existence in its own right; it simply means "barristers as a group".
- In Ireland a practising barrister is also a "member of the Law Library". Can you be a member of one but not the other?
- The 2015-2018 strategic plan has a diagram on page 4 "Who We Are" with three nodes:
- The Bar of Ireland an "independent referral bar" > elect #2
- The Bar Council and Committees "Governing body" > oversee #3
- Executive staff structure services > delivered to #1
- In 2021 the article was moved as suggested on the basis that "The organisation has not been known as the Bar Council of Ireland for many years. In all of its branding, it refers to itself as the Bar of Ireland." It is true that in 2015 the lawlibrary.ie website rebranded from "The Bar Council" to "The Bar of Ireland" (and logo from bar-council-law-library.png to bar-council-logo-new.png [sic!]). But that's a branding rather than substantive change. The strategic plan page 5 says the change was motivated by "a lack of clarity about what the organisation and brand means". I speculate one motivation was Alan Shatter#Minister for Justice (2011–2014), who was a solicitor whose plans were opposed by many barrister; an increased emphasis on the "independent referral bar" as distinct from the "Bar Council" was in part an attempt to oppose any changes. It might be worth looking for some commentary from 2015.
